Q. How, as a buyer, can I get Lindsay to represent only my interests in a transaction?
A. In order for Lindsay to represent only your best interest in a real estate transaction you must sign a form called the Buyer Representation Agreement. Without this form Lindsay is obligated to act as a what's called a sub-agent for the sellers and must work to obtain the highest price possible for the them.
Q. What is a Buyer Representation Agreement?
A. A Buyer Representation Agreement is a standard Toronto Real Estate Board form that establishes and spells out the relationship between you, the buyer, and Lindsay, the sales representative. Once you have signed this form Lindsay becomes legally obligated to pursue your goals and not the sellers. It also places a legal obligation on you, the buyer, to stay loyal to Lindsay and not work with any other real estate sales representatives during the course of your real estate transaction.
Q. Why do I, as a buyer, have to sign an agreement in order to have Lindsay represent my best interests? It never used to be that way.
A. On January 1, 1995, the Canadian Real Estate Association adopted a new Code of Ethics requiring all members to disclose, in writing, their representation relationships with the buying and selling public. If you are buying or selling real estate through any sales representative, they will require a written statement of your relationship. This new system is probably the most beneficial for buyers as it allows them the option of representation in a real estate transaction, where there never was one before.
Q. What are the benefits to me in signing a Buyer Representation Agreement with Lindsay?
A. The following are a few of the benefits of signing a Buyer Representation Agreement:
- It's completely free! It is common practice for the seller or developer to pay Lindsay's fee.
- You save time! By sticking with only Lindsay you create a working relationship where she is fully aware of all of your needs and wants and can therefore show you the right property sooner. Without the Agreement Lindsay is less likely to spend time really searching for a property that meets your needs because she will assume you are not a committed buyer.
- You have a true advocate! Lindsay has a legal obligation to find and then negotiate the best deal for you. If you decide to go into an offer without signing a Buyer Representation Agreement, Lindsay will be obligated to negotiate the best price and terms for the seller as she will be considered a sub-agent for them..
- Your rights are protected! Legally Lindsay is not allowed to disclose any confidential information about you or your buying situation. Without the Agreement Lindsay becomes a sub-agent for the seller and must therefore disclose all pertinent information to them.
- You work with a knowledgeable professional! As a Realtor, Lindsay possesses current knowledge on the real estate market and can provide you with professional advice. She also must adhere to a strict Code of Ethics in order to protect you, her client.
The following scenario is meant to better illustrate the benefit of the Buyer Agency Agreement. In this example think of the restaurant as a seller and you of course as a buyer.
You go out to eat at a nice restaurant; you get a terrible case of food poisoning which hospitalizes you for two weeks so you decide to sue. Do you contact the restaurant's attorney to represent you or do you seek out your own independent attorney to fight for your best interest?
